Sugar Plum Creations Inc. is the owner of HDPIXEL.COM and HIGHDEFINITIONPIXEL.COM,
an Internet picture sharing community of avid photographers who love to use their digital cameras.
Users of HDPIXEL.COM can create online albums and upload picture files to their own album.

By entering into a membership agreement, I certify that I have read, and will abide by, the following terms of service:

No Warranty
I understand that HDPixel.com, owned by Sugar Plum Creations, Inc. (and it's partners and affiliates, including All Enthusiast, Inc. (developers of PhotoPost), shall not be liable for any loss of data, memories, hardware, or any other that may become lost or ir-retrievable, and that I shall waive all liability which might occur in using HDPixel.com's services or promotions, across any media type. I also understand that any executable program or service made available to me, or any service provided to me may become interrupted, corrupted or unavailable at any time, without notice, and that HdPixel will not be liable for compensation. HDPixel strongly recommends backing up all data and memories in two locations on a frequent basis, as we cannot be liable for any lost content.

Content
I understand that subject material of an adult or nude type is not acceptable for uploading, and will forfeit my membership immediately, without recourse or due compensation. I agree to not post any material or content of which is:

(a) defamatory, libelous, obscene, indecent, abusive, threatening to others, or in violation of any law, or
(b) infringes the copyright, trademark right, or any other intellectual property right of any Third Party, or
(c) proprietary material used
without proper authorization,
(d) programs containing TROJAN horses, viruses and / or tools to compromise the security of Sugar Plum Creations, Inc. and / or other internet sites,
(e) solicitations or advertisements,
(f) suggestions or encouragement of illegal activity,
(g) private information about
any individual or group such as phone numbers, addresses, Social Security numbers or any other private information and
(h) duplicate posting or "spamming".

Sugar Plum Creations Inc and HD Pixel.com, does not have ownership or copyright or trademark rights to the content you place in your HDPixel.com albums. We will not use member images for marketing purposes or any other purpose without obtaining your express and written permission.

You are solely responsible for all content that you upload to HDPixel.com. You agree to hold harmless and indemnify HDPixel.com and its officers, affiliates and employees from and against all liabilities, judgments, damages, and costs (including attorney's and other legal fees) incurred by any of them which arise out of, or are related to, the content that you upload.

I furthermore understand, and agree to abide by, using the services of HDPixel.com for a personal nature only, that I will not sell or mislead the likeness of HDPixel.com as my own, and that I will agree that HDPixel.com has the sole discretion to modify, remove, monitor, or otherwise change content that is deemed to be in non-compliance of this Agreement.

Copyright and Trademarks
This service is the personal property of HDPixel.com, which retains the right to bar any individual or entity from its services or products at any time. HDPixel.com, which is owned by Sugar Plum Creations, Inc., is the registered owner of the name HDPixel.com, highdefintionpixel.com, and does not license, or consent you to use their names, trademarks, copyrights, likeness, or services as your own, and does not permit you to use it's names, content or services without it's explicit written permission in each instance.

Terms of Membership
I certify that I have read the terms and conditions as listed above, and that I am a legal adult in my state, province or country, and at least 18 years old if living in the United States of America, or 13 years old with a signed parental consent form on file in conjunction with COPA. I furthermore agree that I am of legal age to enter into a binding contract, and that I waive all jurisdictional right in any litigation which may arise as a result of membership, in any venue in San Bernardino County, or in the city of Rancho Cucamonga, California. I furthermore agree that any or part of this agreement shall remain in survival if my membership is cancelled by myself, or terminated by HDPixel.com for any reason, or found to in dispute in any venue of law. I also agree that I may not charge others to view my posted content in either public or private forums.

If you subscribe to our services, you warrant that the information you submit is true and accurate, including your credit card number and expiration date, and you agree to pay an annual fee. We accept Visa, Master Card, Money Order and Cashiers Check, payable in US dollars. (We charge sales tax if your billing address is in the state of California) You may contact us if you need additional information or have any questions. Being a party to our services means that the account you sign up for is personal to you and the members of your household, and you cannot transfer or give your login and password to others. Membership fees are non-refundable and we do not reimburse funds for unused services.
